Journalist Edmund Kudzayi has filed a request with the High Court to overturn a default judgment that awarded US$100,000 in damages to lawyer Fadzayi Mahere in a defamation case. Kudzayi claims the judgment was made without proper legal procedure and argues he has a valid defense.
The case stems from allegations made by Kudzayi about Mahere’s personal life, which Mahere claims damaged her reputation. Kudzayi argues that his allegations were in the public interest and cannot be substantiated without proper investigation.
Kudzayi claims that he was not given adequate opportunity to present his defense and that the judgment was granted due to procedural irregularities. He also argues that the damages awarded are excessive and unprecedented in Zimbabwean law.
Kudzayi’s legal team argues that the judgment’s value is disproportionate to the alleged damages and that Mahere’s claims are unfounded. They also claim that Kudzayi was obstructed from attending a crucial hearing due to security restrictions at the High Court.
The matter is yet to be heard, and Kudzayi’s application for rescission will be reviewed by the court. If successful, the judgment could be overturned, and the case would proceed to trial.
