Grammy Award-winning musician Nomcebo Zikode has suffered another setback in her ongoing legal battle against Open Mic. The Pretoria High Court dismissed her application for leave to appeal, upholding a previous ruling that her appeal had no reasonable prospects of success.
The dispute between Zikode and Open Mic centers around issues related to her music, including the hit song Jerusalema, which was co-created with Kgaogelo “Master KG” Moagi. However, the court did not rule on the ownership of Jerusalema, instead focusing on a separate issue related to the song Bayethe.
Judge Graham Nasious Moshoana ruled that Zikode’s appeal had no reasonable prospects of success, and ordered her to cover the legal costs of the application. The court also noted that Zikode’s application was flawed due to the incorrect legal procedure she followed.
Zikode’s legal team has expressed disappointment with the court’s decision, calling it “fundamentally flawed and deeply troubling.” They have vowed to continue fighting for Zikode’s rights as an artist.
