Mahere Takes on Government Over Night Vending Crackdown

Fadzayi Mahere, a prominent lawyer and politician, is throwing shade at the government’s recent ban on night vending and second-hand clothes, calling it “legally baseless and unconstitutional”. The ban, announced by Minister Daniel Garwe, has sparked a heated debate, with Mahere questioning the government’s authority to impose such a ban without proper legal backing.

Mahere argues that the government’s decision is nothing more than a press statement, lacking the necessary legal teeth to make it enforceable. “Press statements are not law,” she emphasized, “and administrative action must be lawful, reasonable, and procedurally fair.”

Minister Garwe claims the ban is part of an urban renewal effort, aimed at improving health, safety, and security in city centers. However, Mahere’s challenge has raised eyebrows, with many wondering if the government’s approach is more about optics than actual solutions.

As a vocal advocate for human rights and constitutionalism, Mahere is no stranger to challenging government decisions she deems unconstitutional. Her challenge has sparked a national conversation about the role of government in regulating informal trading and the need for balanced approaches that support vulnerable communities.

The outcome of Mahere’s challenge remains to be seen, but one thing is certain – the debate about the government’s powers and the rule of law in Zimbabwe has been reignited. Will the government back down, or will Mahere’s challenge be the catalyst for change?
