In a stunning move, the National Prosecuting Authority (NPA) has withdrawn its application to seize and forfeit properties belonging to convicted businessmen Mike Chimombe and Moses Mpofu .
The decision comes as a surprise, given that the State had previously expressed its intention to invoke Section 50(1) of the Money Laundering and Proceeds of Crime Act to recover assets linked to the crime .
The NPA’s notice, published on Tuesday, states that the withdrawal is effective immediately, and that the State will instead proceed with pre-sentencing procedures on November 14, as provided for in SL 146 of 2023 .
Chimombe and Mpofu were convicted of defrauding the Government of US$7 million through the Presidential Goat Pass-on Scheme . They have been languishing in jail for over a year, awaiting sentencing .
The case has been marred by controversy, with the State facing criticism for its handling of the prosecution . The withdrawal of the asset forfeiture application has raised eyebrows, with many questioning the motives behind the decision .
Despite the withdrawal, the State has already filed its address in aggravation, which is likely to influence the sentencing . Chimombe and Mpofu face a possible minimum jail term of 20 years .
The case is expected to continue on November 14, with the pre-sentencing procedures set to determine the fate of the convicted businessmen .
